Phoenix, AZ—With Maricopa County Attorney Bill Montgomery’s giving notice of his intent to retry Debra Milke for Capital Murder, I just can’t imagine what he’s thinking! Milke’s convictions and Death Sentence was reversed after spending 23 very miserable years on Death Row.
The 9th Circuit U.S. Court of Appeals recently not only documented former Phoenix police detective Armando Saldate’s redundant practice of perjury in multiple cases the court referred the matter to the Justice Department for an investigation.
Incredibly Montgomery plans to go ahead and call the serial perjuring cop back to testify yet again against Debra Milke. Prosecutors have a duty to seek justice not just win convictions but Montgomery may have lost sight of that.
It was really was not in that long ago in 2006 when another elected prosecutor, Mike Nifong of Durham County, NC, was disgraced, disbarred and actually received a jail sentence for similar conduct in the infamous Duke University lacrosse rape prosecution.
The alleged victim in the Duke case was no less incredible that Montgomery’s star witness, Armando Saldate. Nifong pressed on with his prosecution disaster costing him everything. Nifong soon filed for personal bankruptcy.
Bill Montgomery has clearly taken the low road in the Debra Milke Case trying to shore up the battered reputation of his office and that of a bad cop. During the period when Milke was tried during there was a multitude of similar cases that had a huge negative impact on taxpayers because of Prosecutorial Tyranny. The Temple Murder case, Ray Krone and David Hyde wrongful prosecutions cost millions. More importantly innocent people wound up suffering on Death Row.
It’s still not too late for Montgomery to end this Orwellian nightmare by freeing Debra Milke. It will also help Montgomery sleep better at night.
I made a call to Montgomery’s office for comments on the Milke case and so far no has bothered to comment. Additionally I’ve been banned along with some European reporters from covering Montgomery’s news conferences. Sine Montgomery is not available to me I sent the video message below to him.
