My Video Message to Maricopa County Attorney Bill Montgomery RE: Debra Milke

Maricopa County Attorney Bill Montgomery

Phoenix, AZ—It’s been months since the 9th Circuit U.S. Court of Appeals has reversed the wrongful convictions and death sentence of Debra Milke.
Milke was framed with a manufactured confession by a really despicable former Phoenix cop, Armando Saldate.  As a result this innocent woman has spent 23 years in solitary confinement in a tiny prison cell under the constant and very real threat of being murdered under the color of law.
Maricopa County Attorney Bill Montgomery has to now decide just what additional misery he will put Debra Milke through.   Montgomery has been under a lot pressure to protect the image of law enforcement people that engaged in the deliberate obstruction of justice and at the minimum a reckless prosecution.
Montgomery also has a very real additional duty as a prosecutor to protect Milke from yet another wrongful prosecution.
Bill Montgomery must now make a choice and I have issued the following video appeal to him to promptly take the high road:

Mr. Huebl. you’ve got to understand that Montgomery fears loss of support from the prosecutor’s lobby and the police unions if he does not go to the wall protecting people in law enforcement.

I know he wants this to go away but he fears a massive lawsuit around the corner that will expose his office to scandal.

He wants the defense to plead her out to time already served and Milke has so far refused. She can leave prison immediately if she will just cooperate!

Only one word for that my friend. It's called extortion and it is a CRIME.

You do not understand the court system. When a conviction is overturned the higher court issues a mandate to the trial court for the prisoner to be released as a free person because at that moment they are innocent until proven guilty again. It doesn't take longer than 30 days for a mandate to reach the trial courts. Therefore Milke is being held illegally because she has not been set free.

Keeping Debra Milke in prison IS a crime. I thought the higher court ruled? Arizonans apparently aren't tired enough of rogue prosecutions, prosecutorial misconduct and flagrant conflicts of interest. Why isn't there any DOJ oversight? Who's watching the hen house? The thing that the general public doesn't seem to understand is that if this can happen to Debra, it can happen to them!

For Montgomery that should be no brainer. . What happened at Debra Milke parallels what would happen in a fascist nation. I'd be inclined to start a movement to get Montgomery disbarred like Mike Nifong of the Duke LaCrosse Rape case if he proceeds with another prosecution.
